These terms of use describe your rights and responsibilities when using patients.org and affiliated domains.

1. Acceptance of terms

Your use of patients.org is subject to your compliance with the terms and conditions set forth in this Terms of Use agreement (“Terms of Use”).

The Patients Union The Patients Vote, and The Patients Hub (which, unless context otherwise requires, are referred to in this policy collectively as “The Patients Union” or “We”) reserves the right to update or modify the Terms of Use without advance notice by posting a revised Terms of Use to Patients.org. Users of Patients.org (“you”) can determine whether the Terms of Use have been modified since your last visit by checking the “Last updated” legend at the top of this page. By using Patients.org, you agree to be bound by the version of the Terms of Use then in effect. The Patients Union may deny service to you at any time, including in the event you do not adhere to the Terms of Use.

2. Purposes of patients.org

The Patients Union is organizing patients across the country to build power strong enough to take on the people profiting off our pain and upholding a system that does not work for patients – a force that will fight for us, have our backs, and win the healthcare system we deserve.

The purpose of The Patients Union is to fight for guaranteed healthcare for all.

3. Submissions

The Patients Union welcomes you to share your ideas, comments, written and multimedia content, and other information (collectively, “Submissions”) through the various tools offered on Patients.org subject to your agreement to comply with the Terms of Use. Submissions are shared for public viewing and use on Patients.org, and do not include personal contact information you submit in order to join an e-mail or other contact list, information provided in making a financial contribution, or information solely as part of the process of contacting decision-makers or signing a petition on Patients.org (although signatures on petitions may be made public). Please be aware that by making Submissions through Patients.org, you agree to give The Patients Union certain rights in those materials.

By posting Submissions — you grant to The Patients Union and its designees a worldwide, non-exclusive, sublicenseable, assignable, royalty-free, perpetual, irrevocable right (including any moral rights) and license to use, reproduce, distribute, create derivative works based on, perform and display such Submissions (in whole or in part) in any media now known or hereafter developed, for any purpose whatsoever, without compensation to you or any other provider of the Submissions. You also permit any visitor to Patients.org to access, display, view, store and reproduce such Submissions for personal use.

You acknowledge that to the extent that you include personally identifiable information in Submissions, The Patients Union may republish such information as part of the content. If The Patients Union republishes your content, The Patients Union may provide authorship credit by listing your name as well.

Although The Patients Union has no obligation to monitor the Submissions, you acknowledge and agree that The Patients Union may do one or all of the following: (a) monitor the Submissions; (b) alter, edit, or remove any Submission; or (c) disclose any Submissions. This section will survive any termination or expiration of these Terms of Use.

4. Community rules

The Patients Union uses “Community Rules” set forth below to create a forum where information and progressive views can be shared in a productive way. While using Patients.org, you agree to adhere to the Community Rules below.

You agree to:

• Respect others – by not threatening, insulting, abusing, intimidating or harassing other users.
• Use Patients.org to participate in the Patients.org’s mission, not to promote yourself or your organization. Posting Submissions solely to promote your own projects is not allowed.

You agree not to:

• Post any Submissions or provide links to any Submissions that endorse or oppose a particular political party or candidate for office.
• Post any private information or otherwise harvest, collect or disclose information, about another site user without that user’s express consent.
• Post any content to Patients.org that is unlawful, racist, sexist, homophobic, or otherwise hateful, or libelous, defamatory, obscene, or harassing, as determined in The Patients Union’s discretion.
• Post any content to Patients.org that infringes any third party’s intellectual property or other rights.
• Use Patients.org for any unlawful purpose, or transmit or otherwise make available in connection with Patients.org any material that would give rise to criminal or civil liability.
• Use Patients.org for advertisements, chain letters, “spamming,” survey solicitations, junk mail or solicitations.
• Impersonate any person or entity, including any The Patients Union employees, or falsely state or otherwise misrepresent your affiliation with any person or entity.
• Imply that The Patients Union endorses any of your statements or positions.
• Transmit any harmful, invasive or disruptive code or other materials (such as viruses, worms or web bugs) through or to Patients.org, or otherwise “hack” or deface any portion of Patients.org.
• Frame or mirror any part of Patients.org without prior written authorization from The Patients Union

You acknowledge that The Patients Union has the right, but not the obligation, to modify or remove, any Submissions that violate the Community Rules or that otherwise violate the Terms of Use.

5. Proprietary rights, re-use policy and limits on use

You acknowledge and agree that the information and materials presented on or through Patients.org will remain the property of The Patients Union and its licensors or providers, and are protected by copyright, trademark, patent, and/or other proprietary rights and related laws, rules and regulations. Articles and other text content may have a “byline” indicating the author of that article or other content element. Any such text content may be freely reproduced, copied, and distributed solely for non-commercial purposes, provided that appropriate credit is given and, if the use is online, a link back to Patients.org is provided. All other text content remains the property of its author and may only be reproduced with permission.

Video and audio content labeled “produced by” The Patients Union may be reproduced if used in its entirety solely for noncommercial purposes, with appropriate credit given to The Patients Union and, if the use is online, a link back to Patients.org is provided. No derivative works may be created, and no component elements of audio or video content may be extracted and used outside the work as a whole. All other audio or video content remains the property of its author and may only be reproduced with permission.

Photos, graphics and other images, and any other content not addressed above may be reproduced only with permission of The Patients Union.

“Appropriate credit” means that you attribute the materials to The Patients Union, credit a specific author when one is identified, and provide a link to either the Patients.org home page or the specific URL where the material originated.

You may not make any editorial changes to articles or materials without first receiving express permission from The Patients Union. This provision does not restrict excerpting portions of content in a manner that does not alter the editorial intent.

The trademarks, service marks, logos and trade names displayed on Patients.org (collectively the “Marks”) are the registered and unregistered trademarks of The Patients Union, its licensors and suppliers, and others. All Marks on Patients.org not owned by The Patients Union are the property of their respective owners. The Marks owned by The Patients Union, whether registered or unregistered, may not be used in connection with any product or service from any other organization or individual.

6. Information provided by third parties

Some information made available on or through Patients.org is provided by third parties, such as news services or other Patients.org users. The inclusion or appearance of any third-party content on Patients.org does not indicate any approval or endorsement by The Patients Union. The Patients Union are not responsible for, and hereby disclaim any and all liability that may arise from Third-Party Content.

7. Links

Patients.org provides links to other websites and resources. Because The Patients Union does not have control over these sites and resources, you acknowledge and agree that neither The Patients Union endorses or is responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. The Patients Union provides these links to you only as a convenience. The Patients Union has the right, but not the obligation to block links from or to Patients.org at any time.

8. Claims of copyright infringement

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials hosted by The Patients Union infringe your copyright, you (or your agent) may send notice requesting that the material be removed, or access to it blocked. Notices must include:

• The name, address, and electronic signature of the complaining party
• The infringing materials and their Internet location
• Sufficient information to identify the copyrighted works.
• A statement by the owner that it has a good faith belief that there is no legal basis for the use of the materials complained of.
• A statement of the accuracy of the notice and, under penalty of perjury, that the complaining party is authorized to act on the behalf of the owner.

9. Privacy policy

10.  Jurisdictional issues

Patients.org is controlled and operated by The Patients Union, which is incorporated in Washington, D.C., U.S.A., and neither patients.org nor these Terms of Service are intended to subject The Patients Union to the laws or jurisdiction of any other state, country or territory. By using Patients.org, you agree to waive any legal claim or cause of action based upon the laws of any jurisdiction other than Washington, D.C. and the United States, and you agree that any dispute arising out of your use of Patients.org or otherwise related to Patients.org will be subject to the jurisdiction of the courts located in Washington, D.C. and in no other jurisdiction. You agree to submit to the exclusive jurisdiction of any court located in Washington, D.C., United States of America, and waive any jurisdictional, venue or inconvenient forum objections to such courts, in any matter arising out of or related to Patients.org or these Terms of Use. Those who choose to access Patients.org do so on their own initiative and at their own risk, and are solely responsible for complying with all local laws, rules and regulations.

11. Termination

You agree that The Patients Union, in its sole discretion, may terminate your use of Patients.org or any part thereof, at any time and for any reason, including if The Patients Union believes that you have violated or acted inconsistently with the spirit of the Terms of Use. Further, you agree that neither The Patients Union will be liable to you or any third party for any termination of your access to Patients.org.

12. Disclaimers

Patients.org IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. YOU AGREE THAT YOU MUST EVALUATE AND BEAR ALL RISKS ASSOCIATED WITH THE USE OF Patients.org, AND ANY RELIANCE ON THE ACCURACY, COMPLETENESS, OR USEFULNESS THEREOF. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW DISCLAIMS ALL WARRANTIES WITH RESPECT TO Patients.org.

Patients.org may include inadvertent inaccuracies or errors, or information or materials that violate the Terms of Use. Additionally, the possibility exists that a third party could make unauthorized alterations to Patients.org. Although we attempt to ensure the integrity of Patients.org, we make no guarantees as to its completeness or correctness. In the event that a situation arises in which Patients.org’s completeness or correctness is in question, please contact The Patients Union with, if possible, a description of the material to be checked and the location (URL) where such material can be found on Patients.org, as well as information sufficient to enable a The Patients Union employee to contact you.

13. Limitation of liability

NEITHER THE PATIENTS UNION NOR ANY OF THEIR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES OR CONSULTANTS ARE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY TO Patients.org AND/OR MATERIALS CONTAINED ON Patients.org, ANY LINKED SITE OR ANY CONTENT OR SERVICE AVAILABLE THROUGH Patients.org. YOUR SOLE REMEDY FOR DISSATISFACTION WITH Patients.org, CONTENT, SERVICES OR ANY LINKED SITE IS TO STOP YOUR USE OF IT.

14. Indemnification

You agree to defend, indemnify and hold harmless The Patients Union and its directors, officers, employees and consultants, from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees) and other expenses that arise out of or from (a) your activities in connection with Patients.org; (b) any violation of these Terms of Use by you; or (c) any allegation that any Submissions or other materials you submit to The Patients Union or transmit to Patients.org infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party.

15. Miscellaneous

These Terms of Use are governed by and construed in accordance with the laws of the Washington, D.C., United States of America, without regard to its conflict of law principles. If any provision of these Terms of Use is found to be unlawful, void or for any reason unenforceable, then that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of any remaining provisions. The Patients Union may assign their rights and obligations under these Terms of Use. These Terms of Use, together with all policies referred to herein, are the entire agreement between The Patients Union and you relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements between The Patients Union and you with respect to such subject matter.

16. Mobile terms of service

The Patients Union provides subscribers with text messages about healthcare advocacy, campaign updates, petitions, events, volunteer opportunities, membership opportunities, educational resources, patient support information, and other opportunities to take action to improve healthcare. Messages may also include donation requests.

When you opt in to our text messaging program, we will send you an SMS message to confirm your subscription.

You can cancel the SMS service at any time by replying STOP to any message. After you send the SMS message “STOP” to us, we will send you a confirmation message that you have been unsubscribed. After that, you will no longer receive text messages from us. If you wish to join again, simply sign up as you did the first time and we will resume sending you messages.

Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

Message frequency varies based on your engagement with our campaigns, events, and programs.

Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, please contact your wireless provider.
